Mediation – An Alternate Way to Solve Disputes
Why Mediation:
Court costs money and time. You might have to take an entire day off work to be in court. You might be sitting in court for several hours waiting for the judge to call you. You might not win.
Benefits of Mediation:
You and the other party can discuss your differences. You might be able to reach an agreed and mutual settlement that may be beneficial to each party. Mediation is confidential. Your settlement will not be on the TV news or in the papers or found anywhere on the Internet.
Legal situations can be difficult and stressful. The good thing about mediation is that both parties can try to achieve a mutually agreeable solution to the problem.
You can control what you want; they can control what they want and, hopefully, a solution is found that both can agree to as well. At that time, it becomes a win-win for both parties. There isn’t a judge or jury making decisions for you.
Mediation Costs:
The cost of mediation is usually less than going to court. Costs will vary depending on the case and the number of hours or days of the mediation as well as who is mediating. However, both parties contribute to the mediation thereby eliminating the worry that one party is getting a “free ride.”

Myra Gouger is a Certified Mediator and has been a successful REALTOR for more than 20 years. She is licensed in both the states of Nevada and Texas. During her long career in real estate, she had a wide array of experience that includes negotiation, mediation, dealing with individuals and problem solving. She has mediated countless disputes involving real estate agent to agent disputes, agent to broker disputes, clients to agent disputes and client to client disputes.

Why Mediate
1. Civil Mediation May be Helpful and Possibly Less Expensive
2. Less time away from your business or work.
3. Less preparation for a mediation on your part.
1. Smaller cases may not need an attorney.
2. Filing fees are minimal and you can do it by yourself, if you want.
3. Mediation is confidential. Your information won’t be available to the public.
4. In mediation, the parties get to speak for themselves about their issues.
5. Mediation allows the parties to work together toward a settlement.
6. After a settlement is reached, a new mediation can be rescheduled if new issues arise.
7. Most cases filed in a court of jurisdiction are usually remanded to mediation to unburden some of the overwhelming number of cases from the court dockets.
8. If no settlement is reached in mediation, you can always schedule a hearing before the court.

·Convenient. While some mediations are done in a lawyer’s office, others can be done via zoom. Privacy can be maintained by having each party in a separate zoom room. The other party can’t hear what the first party is saying. In either scenario, you don’t have to go to court and waste an entire day waiting for your case to be heard.
·Confidential – the mediator doesn’t disclose your information to the other party, unless their permission is given to disclose.
·Voluntary – the disputing parties are there to try and resolve the dispute without going to court.
·Control – You make the decisions as to what you want to accept. There is no judge or jury to make the decision for you.
·Faster Solution – Many issues can be solved in days or even a few hours with a mediator.
·Support – Mediators do not favor one party or the other. They are there to facilitate the process to work toward a mutually agreeable solution.
·Preserving Relationships – Mediation can preserve the business or family relationships that have suddenly become strained over the issue.

What Is Mediation?
Mediation is a process in which a trained mediator assists disputing parties with their issues to help them find a mutually acceptable solution to both parties. The mediator does not offer any opinions. The mediator facilitates the exchange of information from each party. Mediation is characterized by cooperation on the part of both parties to reach a mutually acceptable solution. The parties may not each get exactly what they were looking for, but with the help of the trained mediator, they both get what they feel they can “live with.”
Mediators are there to help you negotiate; they will not participate in the decision-making process.
